XenaTech Software Integration Services, LLC, referred to in this Privacy Policy as “XenaTech,” “we,” “us,” or “our,” respects your privacy.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you:

  • Visit xenatech.com;
  • Submit a contact form or other website form;
  • Request or schedule a demonstration;
  • Communicate with us by email, telephone, or text message;
  • Enroll in a XenaTech text-message program; or
  • Otherwise interact with XenaTech in connection with the website.

We refer to these interactions collectively as the “Site.”

1. Scope of This Privacy Policy

This Privacy Policy applies to personal information for which XenaTech determines the purposes and means of processing in connection with the Site.

It does not apply to personal information that XenaTech processes on behalf of a customer through a fleet-management, transportation, passenger-information, smart-city, mobile, Internet of Things, or other XenaTech product or service. For that information, the applicable customer generally determines the purposes of processing, and the information is governed by the customer’s privacy notice, XenaTech’s agreement with that customer, and applicable law.

This Privacy Policy also does not apply to:

  • Third-party websites or services that maintain their own privacy policies;
  • Employee or job-applicant information covered by a separate notice; or
  • Information that cannot reasonably be associated with an identifiable individual or household.

2. Personal Information We Collect

“Personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with an identifiable individual or household. The definition may vary under applicable law.

Information You Provide to Us

We may collect the following information directly from you:

Contact information. This may include your first and last name, business email address, telephone number, mailing address, preferred method of contact, and similar information.

Business information. This may include your employer or organization, job title, professional role, industry, service interests, fleet or transit needs, project requirements, and other business details you choose to provide.

Inquiry and demonstration information. When you contact us or request a demonstration, we may collect the subject of your inquiry, the XenaTech solution in which you are interested, scheduling information, meeting details, and the contents of your message.

Communications. We may collect information contained in emails, telephone calls, voicemails, forms, support requests, attachments, feedback, surveys, and other communications with us.

Customer-relationship information. If you represent an existing or prospective customer, vendor, government agency, contractor, or business partner, we may collect information needed to manage that relationship, prepare proposals, negotiate or perform agreements, provide support, and maintain business records.

SMS information. If you enroll in a XenaTech text-message program, we may collect your mobile telephone number, enrollment and consent records, opt-in and opt-out status, message-delivery information, operational alert information, and messages you send in response to the program.

Marketing preferences. We may record whether you have requested information from us, subscribed to communications, unsubscribed, or expressed other communication preferences.

Required fields will generally be identified when information is requested. If you do not provide required information, we may be unable to respond to your inquiry, schedule a demonstration, provide a requested communication, or complete another requested action.

Information Collected Automatically

When you use the Site, we and our service providers may automatically collect:

Device and browser information. This may include your Internet Protocol address, browser type and version, operating system, device type, language settings, screen resolution, and device or online identifiers.

Usage information. This may include pages viewed, features used, links clicked, referring and exit pages, dates and times of visits, time spent on pages, navigation paths, form interactions, and other information about how you use the Site.

General location information. We may infer a general geographic area, such as a city, state, or country, from an Internet Protocol address. This Site is not intended to collect precise GPS location information.

Diagnostic and security information. This may include server logs, error records, security events, suspected fraud indicators, and information used to maintain the availability and integrity of the Site.

Email engagement information. Where permitted, we may receive information indicating whether a business email was delivered, opened, or interacted with.

Information From Other Sources

We may receive personal information from:

  • Scheduling and meeting-service providers, such as Calendly;
  • Website hosting, analytics, communications, and security providers;
  • Customers, prospective customers, business partners, contractors, or referral sources;
  • Your employer or organization;
  • Publicly available professional or government sources; and
  • Other sources with your authorization or as permitted by law.

Sensitive Personal Information

We do not intentionally request sensitive personal information through the public Site. Please do not submit Social Security numbers, government identification numbers, financial-account credentials, passwords, medical information, biometric identifiers, precise geolocation information, or similarly sensitive information through the general contact form.

3. How We Use Personal Information

We may use personal information to:

  1. Operate, maintain, secure, and improve the Site;
  2. Respond to inquiries and requests;
  3. Schedule and conduct demonstrations, meetings, and consultations;
  4. Prepare proposals and communicate about XenaTech products and services;
  5. Establish, administer, and support customer and business relationships;
  6. Provide requested operational text messages and alerts;
  7. Send service, administrative, security, and relationship communications;
  8. Send business or marketing communications where permitted by law;
  9. Record and honor communication and privacy preferences;
  10. Analyze Site traffic, performance, and user interactions;
  11. Troubleshoot technical problems and improve functionality;
  12. Detect, investigate, and prevent fraud, misuse, security incidents, and unlawful activity;
  13. Protect the rights, safety, property, and operations of XenaTech, our customers, Site users, and others;
  14. Comply with laws, regulations, court orders, subpoenas, contractual obligations, and governmental requests;
  15. Establish, exercise, or defend legal claims;
  16. Evaluate or complete a merger, financing, acquisition, reorganization, sale, or other business transaction; and
  17. Create aggregated or deidentified information for analytics, planning, research, and service improvement.

We do not use personal information collected through the Site to make solely automated decisions that produce legal or similarly significant effects concerning an individual.

4. Cookies and Similar Technologies

The Site may use cookies, tags, scripts, pixels, local storage, and similar technologies. These technologies may be used for:

Essential functions. These technologies support security, network management, form functionality, fraud prevention, and other features needed for the Site to operate.

Functional features. These technologies may remember preferences or support services such as meeting scheduling.

Analytics. These technologies help us understand how visitors use the Site, identify technical issues, measure traffic, and improve content and performance.

The Site uses tag-management technology, including Google Tag Manager, to manage certain website tags. The particular information collected depends on the tags configured through that technology.

Where required by law, we will request consent before placing or accessing non-essential cookies. You may also be able to manage cookies through a cookie-preference tool or your browser settings. Blocking cookies may prevent some Site features from functioning correctly.

At present, the Site does not take action in response to general browser “Do Not Track” signals because there is no uniform industry standard for interpreting them. We will process legally recognized opt-out preference signals when required by applicable law and relevant to our data practices.

5. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

Service Providers

We may use service providers that support website hosting, content delivery, analytics, scheduling, customer-relationship management, email, telephone and SMS communications, information technology, cybersecurity, document management, data storage, and related business operations.

These providers may process personal information as necessary to perform services for us. Where required, we contractually restrict service providers from retaining, using, or disclosing personal information for purposes unrelated to the services they provide.

Independent Third-Party Services

Certain Site links or features may direct you to an independently operated service, such as Calendly. When you interact directly with one of these services, the service may collect information under its own privacy policy and terms.

Your Organization

When you communicate with us on behalf of an employer, government agency, customer, or other organization, we may share relevant communications and relationship information with appropriate representatives of that organization.

Professional Advisers

We may disclose information to attorneys, accountants, auditors, insurers, consultants, and other professional advisers where reasonably necessary for their services.

Government and Legal Recipients

We may disclose information when we reasonably believe disclosure is necessary to:

  • Comply with applicable law or legal process;
  • Respond to a lawful governmental request;
  • Investigate or prevent fraud, security incidents, or illegal activity;
  • Enforce our agreements or protect our legal rights; or
  • Protect the safety, rights, or property of XenaTech, our customers, Site users, or others.

Business Transactions

Information may be disclosed or transferred in connection with an actual or proposed merger, financing, investment, acquisition, reorganization, bankruptcy, sale of assets, or similar business transaction. Where required, the recipient will be subject to appropriate confidentiality and data-protection obligations.

At Your Direction

We may disclose information at your request, with your authorization, or as otherwise described when the information is collected.

Aggregated or Deidentified Information

We may disclose information that has been aggregated or deidentified so that it cannot reasonably be linked to an identifiable person. Where required by law, we will maintain such information in deidentified form and will not attempt to reidentify it except as permitted by law.

6. Sale, Sharing, and Targeted Advertising

XenaTech does not sell personal information for monetary or other valuable consideration.

XenaTech does not share personal information collected through the Site for cross-context behavioral advertising and does not process it for targeted advertising as those terms are defined under applicable U.S. state privacy laws.

We do not provide financial incentives in exchange for the collection, sale, or sharing of personal information.

If our practices change, we will update this Privacy Policy and provide any legally required notice and opt-out mechanism before engaging in the changed practice.

7. SMS and Mobile Information

XenaTech may collect mobile telephone numbers and SMS opt-in consent solely to deliver requested operational notifications, including MTC FSP Driver Distress alerts.

These programs are intended to provide event-triggered operational messages. Unless a separate, valid consent is obtained, they are not used to send marketing or promotional text messages.

We do not share, sell, rent, or provide mobile phone numbers or SMS opt-in/consent data to third parties or affiliates for marketing or promotional purposes.

Message frequency may vary depending on operational activity. Message and data rates may apply. You may reply:

  • STOP to unsubscribe; or
  • HELP for assistance.

Opting out of one text-message program will not necessarily opt you out of unrelated communications for which you have separately enrolled. Additional details are provided in the XenaTech MTC FSP Terms & Conditions.

8. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

  • Respond to and document inquiries;
  • Maintain customer and business relationships;
  • Provide requested communications;
  • Maintain records of SMS consent and opt-out requests;
  • Protect the security and integrity of our systems;
  • Comply with legal, accounting, tax, contractual, and regulatory obligations;
  • Resolve disputes; and
  • Establish, exercise, or defend legal claims.

Retention periods vary depending on the nature and sensitivity of the information, the purpose for which it was collected, the duration of the relevant relationship, the potential risk from unauthorized use or disclosure, and applicable legal requirements.

When information is no longer reasonably required, we may delete, anonymize, aggregate, or securely dispose of it. Information may remain temporarily in backups or archival systems until those systems are overwritten or retired in the ordinary course.

9. Information Security

We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, acquisition, disclosure, alteration, loss, misuse, or destruction.

However, no website, network, storage system, or electronic transmission is completely secure. We therefore cannot guarantee absolute security.

Please do not send passwords, financial-account credentials, government identification numbers, or other highly sensitive information through the Site’s general contact form.

10. International Processing

XenaTech is based in the United States. Personal information may be stored or processed in the United States and in other countries where XenaTech or its service providers operate.

The privacy and data-protection laws of those countries may differ from the laws in your country. Where applicable law requires protections for an international transfer, we will use an approved contractual mechanism or another legally recognized safeguard.

We collect these categories from the sources described in Section 2, use them for the purposes described in Section 3, and retain them according to Section 8.

12. Your Privacy Rights and Choices

Depending on your location and applicable law, you may have the right to:

  • Confirm whether we process your personal information;
  • Access personal information we maintain about you;
  • Obtain information about the categories, sources, purposes, and recipients of your personal information;
  • Correct inaccurate personal information;
  • Request deletion of personal information;
  • Receive a portable copy of certain personal information;
  • Object to or restrict certain processing;
  • Withdraw consent where processing is based on consent;
  • Opt out of the sale or sharing of personal information, targeted advertising, or certain profiling;
  • Limit certain uses of sensitive personal information;
  • Appeal a decision concerning a privacy request; and
  • Lodge a complaint with a privacy or data-protection regulator.

Some rights are subject to exceptions. For example, we may retain information needed to complete a requested transaction, comply with law, maintain security, prevent fraud, preserve legal claims, or exercise other rights permitted by law.

We may need to verify your identity before completing a request. Verification may require matching information you provide with information already maintained by us. We will use verification information only to process the request.

Where permitted, an authorized agent may submit a request on your behalf. We may require evidence of the agent’s authority and may separately verify your identity.

We will respond within the period required by applicable law. We will not unlawfully discriminate against you for exercising a privacy right.

If we deny a request and applicable law gives you a right to appeal, you may email us with the subject line “Privacy Appeal.”

Customer-Controlled Data

When XenaTech processes information on behalf of a customer, such as a transit agency, fleet operator, government entity, or business, the customer may be responsible for responding to privacy requests. In that situation, please direct your request to the relevant customer. We will assist the customer as required by applicable law and our agreement.

Marketing Communications

You may unsubscribe from marketing emails by using the unsubscribe mechanism in the message or contacting us. Even after opting out of marketing, you may continue to receive non-promotional communications relating to an inquiry, meeting, service, security matter, or existing business relationship.

Text Messages

You may opt out of a XenaTech text-message program by replying STOP. Reply HELP for assistance.

Cookies

You may manage cookies through available cookie controls or browser settings. Disabling certain technologies may affect Site functionality.

13. Additional Information for EEA, UK, and Swiss Visitors

Where European Economic Area, United Kingdom, or Swiss data-protection law applies, XenaTech is the controller of personal information collected for its own purposes through the Site.

We rely on one or more of the following legal bases:

Contract and pre-contractual steps. We process information when necessary to respond to a request, schedule a demonstration, prepare a proposal, or perform an agreement with you or your organization.

Legitimate interests. We process information to operate and improve the Site, communicate with business contacts, maintain security, prevent fraud, administer business relationships, and protect our legal rights. We consider and balance these interests against the rights and interests of affected individuals.

Consent. We rely on consent for certain marketing communications, non-essential cookies, or other processing where consent is required. You may withdraw consent at any time, without affecting processing that occurred before withdrawal.

Legal obligations. We process information when necessary to comply with applicable legal and regulatory requirements.

You may exercise applicable access, correction, deletion, restriction, objection, portability, and consent-withdrawal rights using the contact information above. You may also lodge a complaint with the data-protection authority in the country where you live, work, or believe a violation occurred.

14. Children’s Privacy

The Site is intended for business and government audiences and is not directed to children under 13.

We do not knowingly collect personal information through the Site from children under 13. If you are a parent or legal guardian and believe a child has provided personal information through the Site, please contact us so that we can review and, where appropriate, delete the information.

Customer-deployed transportation, school, passenger, or mobile solutions may be subject to separate customer instructions, agreements, and privacy notices.

COPPA imposes specific requirements on online services directed to children under 13 or operators that have actual knowledge they are collecting personal information from such children.

15. Third-Party Websites and Services

The Site may contain links to or integrations with third-party websites and services. XenaTech does not control the privacy, security, content, or data practices of independently operated third parties.

This Privacy Policy does not apply to information collected directly by those third parties. Please review their privacy notices before providing personal information.

16. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our practices, technologies, services, or legal obligations.

When we make changes, we will update the effective date at the top of the policy. If a change materially affects how we use or disclose personal information, we may provide additional notice through the Site, by email, or through another appropriate method.
